The superannuation fund for Victorian authorities and emergency companies companies outsourced its back-office technology and administration to Iress in late 2019.
The fund stated the change would result in “better online systems” for employers and members.
However its board of ESSSuper has now filed Federal Courtroom proceedings in opposition to IRESS and its subsidiary Monetary Synergy Holdings, “citing materials breaches of contract and pre-contractual misrepresentations which have finally impacted its members,” it stated in an announcement.
ESSSuper alleges “quite a few incidents and breaches by Iress … since coming into the contract”, which it sought rectification of “by way of direct engagement and thru utilizing the dispute mechanism clauses within the contract.”
It alleges these “considerably inconvenienced” members and triggered “loss and injury” because the fund spent “money and time” and engaged third events in pursuit of fixes.
“As a member-focused fund, ESSSuper doesn’t enter into litigation evenly,” the board stated in an announcement.
“Nevertheless, given the continuing lack of decision in response to our clearly articulated issues, and the numerous inconvenience to members and the fund, the board has no various however to situation these proceedings.”
Iress denied the allegations in a financial filing [pdf] to the ASX.
“Iress denies the claims made in opposition to it and can file a defence in accordance with the court docket’s timetable,” the seller stated.
“Iress continues to supply the contracted companies to ESSSuper.”
